Class Action Suit - Collins v. Honda

I am compiling a list of questions/concerns regarding the proposed settlement in the class action suit Chris Collins v. American Honda Motor Co., Inc.

My first question is what is the suit about. This is the first I've heard of it, and a search hasn't turned anything up.

I got the letter today. Apparently it is about the transmission problems in the 1999-2001 Odysseys and some other models. The proposed settlement is an extension of the warranty to 109,000 miles or 93 months with release of all claims beyond that. Good deal for someone who has a failure in the 9 mo or 9000 mile extension period, but bad for the person who has the failure at 110,000 miles.

It is important to note that the Class includes all owners of the included vehicles unless the owner actively elects to be excluded from the class. (By remaining in the Class, by default, an owner is effecitvely suing Honda.)

Why is the warranty extention for "109000 car miles" and not "transmission miles"? Is it too much to ask that a transmission last longer than 70000 (i am on my 3rd transmission - replaced twice - every 70000 miles - only one covered by warranty.).

Honda took a risk when they introduced this "next generation" transmission in the 2000 ody. If there would not have been problems then they were genius and sales increased even more (hard to believe). If it failed, they would lose customers or pay big bucks.

The way the settlement is written they would rather lose customers. Do you realize how many Ody's were sold from 2000-present? So many that they built a new plant in Alabama to help produce enough. Remember when these vans were so popular that you had to get on a waiting list? Little did we know how horrible the transmission would be.

I have 106,000 miles on my vehicle and on my 3 rd transmission. There is NO BENENFIT for me on this. I am planning on requesting to not be included in the settlement UNLESS Honda agrees to a "109,000 transmission mile warranty".

I think to limit the transmission to the vehicles miles is bogus and the plaintiff should be smarter than to give in to Honda's request of vehicle miles.

I don't think I'm the only one in this situation...

This is all about attorney fees. The attorneys get ~$8m from the settlement and the vehicle owner gets a few more mile sand months on the transmission warranty.

The letter doesn't mention who pays the attorney fees if the case is lost.

Does the "class" pay? I know this can be the case as I declined to be in a suit once because we would have been liable for the cost if we lost.

There was already a detailed discussion about this letter and why to opt out (I posted several times). I just searched exhaustively but can't find it, is there some reason it would be deleted?

canadian odysseys

I have a canadian odyssey 2000 LX with 84K with the transmission problem as well. The dealer in the US told me initially that it would be covered, but called me three days later to tell me that it was not. Are these also included in the Suit. Any suggestions as to what should I do?
